Co-written by Jordan L. Eftekari, Esq. (1) Â Â Â Â Introduction 2 November 2007 the Wall Street Journal published an article: â?? Got $ 500,000? Â expects U.S. (government?? S EB-5 program for foreign investors by offering green cards for the creation of jobs) â ????. A federal program as an EB-5 (Immigrant Investor Visa), managed by the U.S. Citizenship & Immigration Services (â?? ????), USCIS encourages foreign investors to invest their way of life in the United States known Morrie United Bereza, head of the EB-5 program at the USCIS, said: â?? The opportunity is really nice for people who live and bring their energy to the United States wants, and it creates economic growth and jobs, especially for Americans. â?? There are 10,000 EB-5 visas available each year, issued only 867 in 2007. Â On the basis of the favorable currency arbitrage (euro / dollar, British pound / dollar) EB-5 Visa is a low cost, efficient time to the U.S. to immigrate A investor (and his immediate family) now have green cards (permanent U.S. residence ) and EB-5 visa by investing in government approved a $ 500,000 Regional Center (currently more than 30 regional centers). For investors to obtain permanent resident safety in the United States without a visa repeated applications. Citizenship can be achieved after five years. Investment in one of three forms to be made with Visa EB-5: Invest $ 1,000,000 in a company and hire ten employees anywhere in the United States or invest $ 500,000 and hire ten employees in a region where unemployment is above the national average of 150% or rural population is 20,000 or less to invest $ 500,000 in a government designated Regional Center and to avoid direct employment. The $ 500,000 investment is the cheapest way to satisfy the visa requirements to obtain a green card permanent after the period of two years. Â If the first two types of investment lead to the permanent green card status, they need more shows at the end of the period of two years, ten qualified persons have maintained jobs in the targeted jobs. The minimum investment is about three years. Â If an investor can immigrant background, they demand one?? Conditionses? removed after one and nine months in the U.S.. Treatment can take up to six months. â?? Distance Education? means that investment is related to the EB5, and the investor is then free to sell the investment. The EB-5 Visa investment can be a passive investment, do not require active management company. A with a green card through EB-5 Visa investment investors can take any job, run a business, retire and live anywhere in the United States, with the advantages enjoyed by U.S. citizens whose property or education. (2) Â Â Â Â history of EB-5 program “EB-5 Visa was launched in 1991. In 1991 the investor for an EB-5 visa was necessary to make an investment of at least $ 1,000,000 $ 500,000 (created in an area targeted unemployed) necessary investments to 10 jobs. Â Â Â Â Â Â Â Â Â For the first two years, the program for those who invest and set up to produce their own businesses established at least ten jobs. But in 1993 the government began to designate certain establishments in regional centers. businesses, which is initially in a region where unemployment has been above the national average of 150% or the rural population falling below 20,000 in the Regional Center and were then be eligible to duly authorized by the CIS (formerly INS). Â Â Â Â Â Â Â Â Â Between 1993 and 1998, several companies have been named as the regional centers. These companies have all of the foreign capital from foreign investors in the EB-5 visa program involved contributed. The competition for foreign capital and the novelty was the EB-5 Visa program leads to abuse of the system. Most companies do not offer sound investments and were really in business to collect fees rather than to finance a business course. Many investment opportunities did not bring the total investment capital rent of $ 500,000 or the required number of employees. Â Â Â Â Â Â Â Â Â CIS law wanted these violations stop against the program. In 1998, IEC wrongly applied their revised rules to persons whose applications had already been approved. CIS has attempted to revoke the permits. It started the controversy. The dispute that the program is the warning from 1999 to 2002 followed. Â Â Â Â Â Â Â Â Â In 2002, Congress passed before a new law to protect investors in 1998. In 2002, in one case as “Chang” 9th Circuit Court of Appeals ruled that the IEC does not apply retroactively announced new rules. In August 2003 CIS began to approval by the regional center EB-5 visa petitions for the first time since 1998. The EB-5 Visa program was amended in 2002 by the following law (PL 107-273 sec. 11 037 â?? 2002): Â Â Â Â Â Â Â Â Â Â Â? A regional center has jurisdiction over a limited geographical area, which are described in the proposal in line with the common goal of the concentration of investments in specific economic zones. Â The establishment of a regional center may, at general forecasts made include the proposal in respect of the types of commercial enterprises, the capital received from foreigners who will work directly or indirectly as a result of these investments created and other positive economic effects of such investments.”In 2002, investors can get $ invest 500,000 in a regional center (in the target area of unemployment) to create without the need to 10 jobs. Â For the $ 500,000 investment, receives an investor a â?? Conditional Green Card. â?? Â Â Â Â Â Â Â Â Â to improve in January 2005 and to expedite EB-5 regional center applications USCIS established an Investor and Regional Center Unit (â?? ircu ????). Unity is the only tribunal for the regional center applications under the Immigrant Investor Pilot Program for approval, denial, and the demand for rooms (ER’s). The unit also monitors and monitor actions approved regional centers to ensure compliance with the conditions, scope and conditions for its approval / designation in terms of to ensure their approved business plan and indirect methods of creation jobs. Finally, developed the device and EB-5 programs, policies and regulatory changes and improved management of the USCIS. The CIS is constantly pursuing its efforts to accelerate and organize the EB- 5 program. By January 2009 there were three different places to store the visa and / or petitions regional center. At present, the IEC is a unit created in California service and uses it as an exclusive meeting place for EB-5 Program file. This center is dedicated, specially trained arbitrators EB-5 arbitration composed. Â The consolidation of the Center, USCIS believes that it is able to reduce a total processing times and better monitoring of EB-5 in connection with arbitration. (3 ) Â Â Â Â U.S. tax matters one??? In Shanghaiist’s Philanthropist feature, we highlight individuals and groups doing interesting things to make the world a little bit of a better place. This week we talk to Seven Fund, who in addition to making the largest personal donation to Roots & Shoots, simply define the term “nice people.”

Every so often, you come across the group that transcends the general rules of relationships, charity work, and general goodwill, and who makes us seriously reconsider what we’ve been doing for the last ten years.

Such is the case of Seven Fund. This private group (with seven members, natch) just donated 25,000 rmb to Roots & Shoots’ Million Tree Project, about which we covered here. They alone secured 1,000 trees in Kulun Qi, Inner Mongolia. And they’re not done yet: they’re hoping to donate 40,000 rmb to a Hope School in Anhui Province to build sports facilities, and are searching for a third project to fund this year.

“We’re just looking for meaningful activities that can make a difference,” said Angela Wang, the group’s resident spokeswoman.

This outpouring of generosity is part of what makes Seven Fund unique. Instead of focusing on coordinating projects, they are focused on funding them. They have an annual budget of 100,000 rmb (a “cost” divided among the members of the group) and have dedicated themselves to finding Good Things to Do.

Everything about the group is also refreshingly and humbly homemade — they choose the projects, they go out and oversee each project. Even Ms. Wang, one of the seven members, was only chosen as a spokesperson when Roots & Shoots encouraged them to do so.

“This attention is very new. We thought we would be low profile,” said Ms. Wang. “But anything to give focus to Roots & Shoots, to encourage people to help.”

The formation of Seven Fund (b. 2010) was a long time coming. The four women of the group first met over ten years ago, when they all worked at Unilever. In an unbelievably envy-inducing feat, the coworkers got along splendidly, and have since been the best of friends. Three of them are married — rounding out the last three men of the Seven Fund.

Charity work was also not something new. They had all individually worked as volunteers or as sponsors in a variety of worthy causes. One family funded a scholarship for low-income students to attend high school. Another collected and donated toys to a kindergarten for disabled youth here in Shanghai. Yet another fueled the construction of a Hope School — the same school for which they plan to build sports facilities. The foundation of Seven Fund came about when they realized they could do more together — to share information and designate responsibilities.

The focus on the environment, instead of education, is also something new. “It was something that came naturally. After one couple came back from Australia and told us about the environment there, we knew that there was much work to be done in China,” said Ms. Wang. Education and environment, she mused, was something that was on the forefront of Seven Fund’s agenda.

“Two couples in our groups have kids. One is eight, one is two. We were thinking about their future. We were happy to help the Million Trees Project. Roots & Shoots were doing something very great.”

As for the future of the Seven Fund, Ms. Wang is humble. “We never thought that anybody would be interested, or that anybody would like to join” she laughs. “It’s just that, over the last ten years, we have had a lot of time to think about our values, and we thought contributing to society was important. We’re just happy to help.”

Be sure to check our Shanghaiist Calendar for more info.

FRIDAY

Want an unconventional Easter celebration? Then head to Get Laid at Chinatown. Cover is free to this invite-only private shaker, complete with showgirls, if you print out the flyer. Starts at 11pm.
Chinatown, 7/F, 100 Zunyi Lu, near Xianxia Lu 遵义路100号7楼, 近仙霞路

Sin Club promises hip hop and house back to back all night long to dance the week away. Hong Kong’s Fat J and Australia’s Stanley will be on the ones and twos. 100 RMB cover charge.
Sin Club, 23/F, Want Want Plaza,
211 Shimen Yi Lu 石门一路211号, 旺旺大厦23楼

If you’re thinking more psychedelic than bass, then head to MAO for Ben Huang’s set, Colour. Expect a blend of electro, house, and minimal. And the best news, ladies? MAO, 46 Yueyang Lu, near Dongping Lu 岳阳路46号，近东平路

Kicking off the night will be a jazz concert of Chinese folk songs featuring Yue Yan on vocals, Steve Sweeting on piano and Jeremy Moyer on erhu, banjo and percussion.
